1. Introduction & Acceptance

Welcome to Visolix ("we," "our," or "us"). By registering for an account, accessing, or using the Visolix API, you agree to be bound by these Terms of Service ("Terms"). These Terms affect your legal rights and obligations. If you do not agree to be bound by all of these Terms, do not access or use our Service.

1.1 Eligibility (Age Restriction)

By using our Service, you represent and warrant that you are at least 18 years of age. If you are under 18, you are strictly prohibited from using the Service or making any payments.

We reserve the right to update these Terms at any time. Continued use of the API after changes constitutes acceptance of the new Terms.

2. Disclaimer of Affiliation

Visolix is an independent service provider and is NOT affiliated, associated, authorized, endorsed by, or in any way officially connected with any of the third-party platforms, social media networks, or video hosting services supported by our tool.

The names, marks, emblems, and images of any third-party platforms are registered trademarks of their respective owners. We operate solely as a technical tool for data retrieval.

3. Access & API License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the API solely for your internal business purposes or personal use.

3.1 Restrictions

You shall not:

• Sell, lease, or sublicense the API access itself to third parties.
• Use the API to build a competing product or service.
• Attempt to reverse engineer, decompile, or discover the source code of the API.
• Exceed the rate limits or usage quotas associated with your plan.

4. Permitted Use & Content Restrictions

IMPORTANT: Personal Use Only

You agree to use the downloaded content strictly for personal, non-commercial purposes (e.g., private viewing, offline study). Any commercial use, distribution, or public performance of the content is strictly prohibited unless you have obtained explicit written permission from the content owner.

4.1 Copyright Compliance

You acknowledge that:

• No Ownership: You do not acquire any ownership rights to the content by downloading it.
• Permission Required: You must NOT use, copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content for any other purposes without the prior written consent of the respective licensors of the content.
• User Liability: You are solely responsible for any copyright infringement arising from your use of the API. Visolix disclaims all liability for your infringing activities.

5. Credits, Payments & Refund Policy

• Prepaid System: Services are provided on a prepaid credit basis. Credits are deducted in real-time per successful request.
• Pricing: We reserve the right to change pricing per endpoint at any time without prior notice.
• No Refunds: As detailed in our Refund Policy, all sales are final. We do not offer refunds (pro-rated or otherwise) for unused credits or account terminations.

6. Indemnification

You agree to defend, indemnify, and hold harmless Visolix and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including expenses, arising out of or in any way connected with:

• Your access to or use of the Service.
• Your violation of these Terms.
• Your infringement of any third-party right, including intellectual property rights.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISOLIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall our aggregate liability exceed the amount you paid to us in the past three (3) months.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service.

9. Zero Tolerance Policy

Strict Prohibition on Illegal Content:

You must strictly NOT use the Visolix API to download, process, or distribute:

• Child Sexual Abuse Material (CSAM)
• Non-consensual sexual content
• Terrorist propaganda or extremist content
• Content that promotes hate speech or violence

Violation of this policy will result in immediate account termination, IP ban, and reporting to relevant legal authorities (e.g., NCMEC, Cyber Crime Cell).

10. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

• Jurisdiction: Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in India.
• Arbitration: We reserve the right to seek injunctive relief in any court of competent jurisdiction.

11. Modifications to Service

We operate in a dynamic environment dependent on third-party platforms. You acknowledge that:

• We do not guarantee the permanence of any specific endpoint or feature.
• API response structures may change without notice if source platforms update their systems.
• We are not liable for any code breakage in your application resulting from such changes.

12. Fair Usage & Monitoring

To ensure quality service for all users, we reserve the right to:

• Monitor your API usage patterns to detect abuse.
• Throttle or limit requests that exceed reasonable limits or burden our infrastructure.
• Sharing your account credentials or API keys with multiple users is strictly prohibited.

13. Miscellaneous

13.1 Force Majeure

Visolix shall not be liable for any failure to perform its obligations where such failure results from any cause beyond Visolix's reasonable control, including, without limitation, mechanical, electronic, or communications failure or degradation (including "internet-service" provider failure).

13.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

13.3 Entire Agreement

These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and Visolix regarding the use of the Service.
